The Demise of the 28-Article Ceasefire Plan for Ukraine: How Peace Negotiations Continue to Falter

Europe felt a moment of respite on Monday, as the diplomatic emergency triggered by the introduction of a new 28-article proposal for ending the war appeared – momentarily – to have been contained. A senior US official spoke of "substantial progress" after Ukraine-US talks in Geneva. On Monday night, Moscow made its retaliation: another massive barrage of rocket attacks on Kyiv.

The Cycle of Negotiation and Warfare

The chain of conflicting incidents captured the harsh reality of the current period. By day, political struggles are conducted: positive announcements are released from multiple capitals. Significant resources is allocated on managing certain initiatives. By night, the Kremlin brutally reminds the world that, for them, conflict continues to be the main instrument for achieving "resolution".

Nocturnal Warfare

As military strikes progressed into the early hours of Tuesday, the current condition of Ukraine's vulnerability was laid bare. Ukraine is equipped to monitor missile launches from across the border, a capacity provided through timely intelligence. From witness perspectives, Ukrainian air force fighter jets that had been dispatched to intercept incoming guided weapons roared overhead – advanced fighter aircraft provided to Ukraine by European allies.

Moments later, Kyiv's anti-aircraft weapons activated: multiple launches targeted at a hostile projectile. This was a modern interception technology at work, presumably provided by allied countries. Every deployment jolts you unexpectedly, shaking the windows. The brief panic quickly transforms into grim resignation: perhaps the approaching threat won't strike its target this time, protecting urban areas from catastrophe and another blackout.

Ongoing Risks

Not long after, a heavy machine gun engaged a unmanned aircraft close by, part of a mobile-fire group – probably Western-made equipment. Regrettably, the projectiles didn't strike the opposing UAV – it maintained course toward its target.

Intermittently, this persisted until dawn. Kyiv faced the early updates: several casualties, damage and infrastructure problems in numerous residences as a result of the nocturnal offensive. As typically, everyone still continued their routines – experiencing conflict. But those 24 hours encapsulated Ukraine's vital need on external assistance – a reliance that regional partners are demonstrably unable to replace in the near term.

Ineffective Peace Efforts

The comprehensive proposal from US administration generated strong feelings, discussion and serious worry – and briefly redirected concern from Ukraine's major integrity crisis in years. Yet, we have experienced comparable situations, after prior negotiation attempts and bilateral conferences.

Every new approach from Washington follows the identical sequence: a negotiation push against Ukraine, which Kyiv, with other European capitals, succeeds in resisting. They stabilise the situation but never actually achieve victory. This pattern will, undoubtedly, endure.

Political Considerations

It is tempting to accuse specific actors of persistently promoting Russian terms. But that does not seem to be the complete picture. US administration works based on a premise familiar among experienced diplomats: you cannot win at the negotiating table what you have been unable to protect through force. The White House presumes that it is unfeasible to pressure the Kremlin to surrender the territory that it currently occupies in Ukraine's southern or eastern regions.

The problem is that while recognising this factual reality, Washington does minimal to discourage Russia, through words or deeds, from believing that the status quo will not change more in its favour in the months ahead.

Divergent Views

Therefore, the Kremlin is convinced that the clock favors them – that Ukraine and its supporters are approaching exhaustion. Their motivation to accept conditions that does not give them the greatest potential benefit is almost completely absent. There may be many attempts to end hostilities, but they will continue as long as Russia's leader remains completely certain in the conclusion.

On the contrary, Ukraine's government believes that Ukraine can still persist, gradually sacrificing people and territory but avoiding a entire defensive failure until situations evolve in its advantage.

Current Realities

Realistically, there are no real preconditions for a truce. Now, subjective factors are entering the equation: personal goals to broker a ceasefire and obtain worldwide acknowledgment, and the government's twin challenges – on one hand, not to alienate a key ally, and on the other, to unite the population around the flag against any plan Kyiv finds unworkable, so that their focus does not switch to domestic problems. And although their objective will now be considerably more difficult after current events, it remains highly unlikely that this will modify their basic position.

These two forces are driving the talks.

Summary and Prospects

It took a only one week to eliminate the 28 points of the latest plan. Aggressive and erratic handling of the matter by American leadership, pushback by Ukraine and the other European countries, along with soothing efforts of negotiators, and finally, latest revelations, all served their function.

While new initiatives based on previous concepts are approaching, Kyiv, London and other allied nations should reach an essential realization: Ukraine and Europe will only be able to counter diplomatic offensives from Washington that are founded on Moscow's terms and show certain reluctance to change the course of events, if they maintain solidarity and strengthen their defence capabilities at a considerably quicker tempo. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's capability to defend against evening bombardments will, for the foreseeable future, mainly require sustained allied backing.
